The CAN-WINSM Negotiation Process

What is CAN-WIN?
CAN-WIN is a new assisted negotiation process designed to increase the efficiency of settlement negotiations. In essence, the process avoids unproductive time, expense, and stress being spent during the settlement negotiations. CAN-WIN offers parties a dispute resolution service that is rendered efficiently, using cutting-edge technology, while preserving traditional rights and procedures.

How does CAN-WIN work?
By a pre-conference information exchange (either by mail/fax or over the Internet), the facilitator, using dispute-specific questionnaires, gathers information and uses it to prepare a synopsis of the issues, risks, and costs involved in the dispute. Then, using panels of experts and state-of-the-art computer analysis, the facilitator provides the parties with an objective evaluation before commencing settlement negotiations.

During the settlement negotiations, the facilitator can use interactive computer analysis to help the parties prioritize issues and build consensus. CAN-WIN also offers a unique Internet On-line Conferencing System for conducting negotiations.

What are the benefits of CAN-WIN?
CAN-WIN better prepares the parties for their negotiations. By gathering information, identifying issues and interests, and determining values in advance of the negotiations, the parties are better able to communicate in a meaningful way. Utilizing computer-aided negotiation software, CAN-WIN helps the parties reach agreement. Also, where time and distance constraints or other factors make in-person negotiations impracticable, the CAN-WIN process can meet the parties' special communications needs.
